A founding partner of ARHM&F, Patricia Hernandez practices in the areas of corporate and financial services, particularly in counseling businesses, including banks and financial services companies, in a wide range of legal issues.
A significant part of her practice involves the representation of foreign entities, including a number of Spanish and Latin American banks, in transactions and regulatory matters in the United States. Ms. Hernandez has assisted several foreign banks with respect to their entry into the United States and represents domestic financial institutions and U.S. offices of foreign banks with respect to their day-to-day activities, including regulatory compliance. She has also developed extensive knowledge in the area of privacy and compliance with the requirements of the Gramm-Leach-Bliley Act and has achieved specific expertise in lending transactions, including asset-based financing. Ms. Hernandez has exceptional experience in counseling other types of foreign businesses who wish to launch their products and services in the U.S. In addition, Ms. Hernandez represents United States corporations doing business abroad with respect to a variety of legal issues. She also has extensive practice in counseling U.S. and foreign clients on the effects of the U.S. trade embargo of Cuba on their businesses.
To better assist her clients in all areas of law, Ms. Hernandez has developed close relationships with local counsel throughout Latin America. Representative matters include mergers and acquisitions, establishing subsidiaries and affiliates abroad, distribution and sales agency arrangements, telecommunication matters, trade issues, regulatory matters and documenting lending and other types of business transactions. Ms. Hernandez has experience representing foreign governments in their privatization efforts, especially in the financial services area, and has represented a number of U.S. clients, including several telecommunication concerns, in their participation in foreign privatizations.
As an undergraduate of the University of Miami, Ms. Hernandez earned a Bachelor of Arts degree, magna cum laude and was a member of the Phi Beta Kappa honor society. She went on to earn a Juris Doctorate degree, cum laude, also from the University of Miami. While at the University of Miami she served on the University of Miami Law Review, was Director of the Student Legal Research Center and a member of The Order of the Coif.
Ms. Hernandez is a member of The Florida Bar, the Dade County Bar Association and the Cuban American Bar Association. Additionally, Ms. Hernandez is the President of the South Florida Banking Institute. She is also active in mentoring law students at the University of Miami School of Law.
Among her many recognitions, Ms. Hernandez was a recipient of the Chivas Regal Order of Distinction awarded annually to young Hispanics who have made significant contributions to the community and has also been recognized as one of South Florida's top banking and finance attorneys by the South Florida Legal Guide and one of the “Best Lawyers in America” in 2010. She has also recently been ranked as a top Banking attorney by Chambers USA.
